MANAGEMENT RULES FOR THE REGULATION OF LAHINCH LEISURE CENTRE, GYM AND SWIMMING POOLS.
Lahinch Leisure Centre (hereinafter referred to as ‘the Organisation’) hereby makes the following
Management Rules (hereinafter referred to as ‘the Rules’) for the regulation in good and proper order of the Various leisure facilities , under the management of the said Organisation.
Criminal Justice (Public Order) Act 1994 (hereinafter referred to as ‘the 1994 Act’),
The Board of Management as the owner of the premises has agreed Management Rules which are enforced by the Organisation as its operating authority.
The Board of Directors: The Manager (on behalf of the Board of Directors of the organisation) of the relevant premises (which expression in these Rules shall include any authorised members of staff) shall have general charge and control of the relevant premises.
The Manager may require any person considered to have broken any of the Rules to leave the relevant premises and that person shall at once leave and may be refused further admission.
Definitions:
In these Management Rules:
“Person” means any person having the right, under these rules, to the use of the various Leisure Facilities,
Gym, Swimming Pools or the facilities or equipment therein and to spectators and generally anyone in the relevant premises for the time being. Entrance to the relevant premises and all tickets for admission are issued subject to compliance with these Rules.
“Premises” means the whole of the various Leisure Centre, Gym and Swimming Pools including any
changing rooms, shower/toilet areas, playing areas, halls, spectator areas, cafeterias and reception/entrance areas.
“Manager” means the Managing Directors of the organisation or General Manager or authorised member of staff.
Admission of the Public/ Members
No person shall:
- a) enter the relevant premises without having first paid for and obtained an appropriate ticket of
admission or before permission has been granted by the Manager;
- b) enter the premises while knowingly suffering from any contagious or infectious disease;
- c) if 11 years of age or under, be admitted to the swimming pool unless accompanied by a responsible person over 16 yrs. who can swim or unless satisfactory supervision has been arranged with the Manager; Children 8yrs and under must be accompanied by an resonsibile adult over 18yrs of age.

- d) remain in the relevant premises or any part thereof contrary to an instruction by the Manager, or for a longer period than permitted by the Manager;
e)Only Lahinch Leisure Centre licensed personal trainers are permitted to train members in the Gym unless granted express permission in writing from Lahinch Leisure Centre Management. Anyone else undertaking members’ training will be asked to leave the gym immediately.
- f) enter or remain in any part of the relevant premises after the time fixed for its closing;
- g) remain in the relevant premises after an emergency situation has been made known to them.
- h) All members must swipe in at reception or designated zones before entering the facilities. Any members found using facilities without prior payment will be ask to leave that area by staff/management and will result in the admission fee being applied.
All are at the Manager’s discretion.
Protection of Privacy
No person shall:
- enter a dressing area or dressing cubicle or shower room reserved for the opposite sex, except that a child of seven years of age or under, may enter a dressing area or dressing cubicle for the opposite sex if accompanied by a responsible person and after express permission has been granted by the Manager;
- disturb or wilfully intrude upon or interfere with the privacy of any other person in the proper use of a dressing or shower cubicle, or facilities generally within the relevant premises.
- No videos or photographs should be taken under any circumstances in the pool and changing room areas.
Valuables and Clothing
The Organisation shall not be held responsible and does not accept liability for the loss of (or
damage to) wearing apparel, property or valuables left in the dressing rooms or any other part of the
relevant premises. Persons using the relevant premises must use any lockers provided for storage
of clothing and valuables.
Dress and Equipment
No person shall enter or remain in the relevant premises if his or her dress is considered by the
Manager to be unsuitable and in particular no person shall wear bathing dress considered by the
Manager to be unsuitable. Every person shall, before leaving the relevant premises, return to the
relevant office, or place in the receptacle provided for this purpose, any articles or equipment that
may have been hired or supplied for their use.
Protection of Water in Pools
No person shall:
- a) enter any pool before first washing in the pre-cleansing/shower area and making use of the toilet facilities;
- b) foul or pollute the water in any way whatsoever.
Prevention of Injury
No person shall:
- a) disobey or ignore any instruction or order given by the Manager or staff in the interests of health and safety;
- b) enter the relevant premises in a state of health or other condition which might reasonably be
expected to endanger or cause harm or injury to oneself or others.
General Provisions as to Good Order
No person shall:
- a) bring or cause to be brought into the relevant premises any unauthorised alcoholic or intoxicating
liquor or drugs;
- b) enter the relevant premises while under the influence of drink or drugs;
- c) smoke in or around the relevant premises;
- d) use profane, indecent or offensive language or behave or conduct oneself in an indecent, offensive, insulting, disorderly or violent manner;
- e) wilfully damage any article belonging to the Organisation or attempt, plan or conspire or do any act likely to wilfully damage the same;
- f) bring or cause to be brought into the relevant premises, glassware of any description unless agreed by the Manager;
- g) disobey or ignore any instruction given by the Manager or staff. Respect must be shown to all members and staff. Failure to do so is grounds for termination of membership and a excursion order placed.
Exclusion of Animals
Except with the consent of Manager, no person shall cause or allow any dog (other than a working
dog accompanying a disabled person) or other animal belonging to him or under his control to enter
or remain in the premises.
Swimming Pools – Provision as to Games etc
Unless during club hours (or as otherwise sanctioned by the Manager) organised games, races or
competitions are forbidden.
Contravention of Management Rules
- a) The Manager may
(i) if he has reasonable grounds for believing that a person has contravened, is contravening or
is about to contravene any of the foregoing Management Rules, expel that person from the
relevant premises.
(ii) if he has reasonable grounds for believing that a person is about to contravene any of the
foregoing Management Rules, exclude that person from the relevant premises.
A person who persistently contravenes or attempts to contravene the foregoing Management Rules
and is, in the opinion of the Organisation, likely to contravene them again shall be liable to be made
the subject of an Exclusion Order by the Organisation for a period determined by the Manager, in
terms of 1994 Act.
- b) Any person who
(i) on being required to leave the relevant premises by the Manager who has reasonable
grounds for believing that the person has contravened, is contravening or is about to
contravene any Management Rules, fails to leave;
(ii) on being informed by the Manager, who has reasonable grounds for believing that the
person is about to contravene any Management Rules, that he is excluded from the relevant
premises, enters or attempts to enter the relevant premises;
(iii) being a person subject to an Exclusion Order under 1994 Act enters or
attempts to enter the relevant premises to which the Exclusion Order relates
shall be reported to the Gardaí .
Cancellation Policies
We would like to take this opportunity to remind you that our activities have restricted availability and many of these activities sell out. For this reason, we request that you cancel at least 90 minutes before your scheduled activity. This will allow us to offer your spot to another customer. You may cancel through your online account or call the Leisure Centre between the hours of 6am – 10pm weekdays or Saturday & Sunday between 9am – 5pm to cancel.
Please note, Lahinch Leisure Centre Have a strict no refund policy on all memberships, fitness classes, courses PAYG transactions and events. These include but are not limited to swimming lessons, gym/swim activities and fitness classes. However, if you give us sufficient notice of your need to cancel on certain activities, we will part credit (less deposit) your payment toward another activity. If you do not cancel with at least 90 minutes notice, you will lose any payments you have already made.
Notice periods required:
Fitness class – 90 mins
Swim/gym session 90mins
Swimming Lesson course 48hrs
Please be advised failure to attend 3 or more sessions in a 30 day period may result in you loosing access to our booking system for a 7 day period in the future. (see terms & conditions policy)
Swimming Lessons
Lahinch Leisure Centre operates a strict no refund policy on swimming lessons.
If you give sufficient notice of your need to cancel a part credit will be offered towards other activities in the centre.
Users of the relevant premises are reminded that the provisions of the general law apply at all times.
Cancelation within 14 days of the start of a new set of swimming lessons term will get full credit of payment made.
Cancelation within 48 hours of the start of a new set of swimming lessons will get a 50% credit of payment made.
If an individual is unable to attend lessons for medical reasons, credit will only be given for periods of absence greater or equal to 4 lessons and on receipt of a doctor/physio letter. Please speak to the Swim Coordinator.
Membership Terms and Conditions
- Cancellation and Financial Terms
- An Annual or Fixed membership packages are offered for a minimum of 12 months whereby you are committing to a 12-month term and are not able to cancel within this period. All other membership agreements i.e. 1, 3 and 6month memberships do not come with a Direct Debit facility option.
- Members can pay either by annual subscription in advance, or monthly by Direct Debit. For granting this credit, members pay 2 months payments in advance. For further details, please see the Direct Debit Mandate
Terms and Conditions. For the avoidance of doubt this agreement is not a Consumer Credit Agreement.
- Members joining in person at the Centre are not entitled to a 14-day cooling-off period
- Your membership will commence on the Start Date (as defined at point of joining), after which time you agree to be bound by the terms and conditions stated in this contract along with the Core Terms and Conditions and any other applicable terms and conditions.
- The membership term, if Fixed 12 months, is a minimum of 12 months and your Direct Debit payments will continue beyond 12 months until such time you advise us in writing of your intention to cancel.
- The Member can, at any time beyond the 12-month initial membership term, cancel their membership by providing us with a full calendar month notice. All membership fees will be payable up to the date of cancellation.
- If you wish to cancel your membership agreement with us you must do so by emailing info@lahinchleisurecentre.ie. Once processed you will receive confirmation of the cancellation, you can then cancel your direct debit instruction at your bank. If the cancellation terms are not followed legal proceedings may be taken and administration charges will apply.
- Where a Direct Debit has failed or a member has purported to have cancelled their Direct Debit without prior agreement, the membership shall be suspended until payment is received and you will be liable for any bank charges incurred. Any member who falls behind in payments for more than 1 calendar month will forfeit his/her membership. Upon failure to make payment, subsequent reinstatement of the membership or any
future membership will be subject to the outstanding membership fees being paid in full. If the contract terms are not followed legal proceedings may be taken and administration charges will apply.
- In exceptional circumstances, e.g. injury or pregnancy, you may be allowed to freeze your membership for an agreed period (up to a maximum of 6 months). This request must be made via email toinfo@lahinchleisurecentre.ie stating the reason for the freeze and including supporting medical evidence.
Once processed you will receive confirmation of whether the freeze period has been accepted or not – this must be retained as proof. The frozen period does not count towards your minimum membership term. We reserve the right to decline your application and apply an administration fee for dealing with such requests.
- We will inform you a minimum of 2 weeks in advance of any increase in the price of your membership, by email. It is the members responsibility to inform us of any changes to your personal and contact details including address, telephone number and email address so that such communications may be made. You can also make these changes directly in the membership area of your online booking account or by emailing info@lahinchleisurecentre.ie.
- We reserve the right to update and/or amend the terms and conditions as necessary without prior notice. Members are requested to adhere to the Membership Terms and Conditions at all times.
- We reserve the right to cancel any membership at our sole discretion and without paying compensation.
- All gym users must complete a Health Questionnaire prior to gym use.
- A photograph will be required upon joining for identification purposes . Members will be required to have a photograph taken on their first visit or, thereafter, if not done on first visit. For details on how we will store and use this personal information, please refer to our Privacy Statement.
- We reserve the right to withdraw all or any part of our facilities for short periods of time to carry out routine maintenance and for exhibitions/events. We will always strive to give Members advance warning of these times (where possible) and no refunds/freeze will apply in these circumstances provided they occur no more than 10 times in any 12-month period. If the Leisure Centre is closed for more than 7 days in a row your membership will be frozen for the time relate to the period that the Leisure Centre is closed, but not including the first 7 days. This does not apply if we permanently close a whole facility (for example, the pool, gym, studio ), or if we have to close the facility due to reasons outside our control.
These are the terms and conditions which outline the core contract terms of your membership. For further details of your membership, please see your Membership Terms and Conditions at the back of your membership forms.
Catering.
The provision of all food and refreshments will be our nominated caterers.
Where we do not provide catering, own packaged food can be organised and brought to the facility provided food allergen information is provided by the parent and written consent from the General Manager is obtained.
We accept no responsibility for food brought onto the premises by the parent and/or children.
Events Catering. Any catering brought into the facility may be subject to a cleaning surcharge.
Changing Rooms
- Children under the age of 8 may change in the changing room of their accompanying parent/adult, whether male or female.
- Ordinarily any articles we find, including items left in lockers at the end of the day will be removed and kept in storage for 1 week, unless in times coronavirus where items will be disposed of immediately.
- We are required to keep most found items of clothing/equipment etc. for up to 1 week. After this time, we reserve the right to dispose of these items as we see fit. For hygiene reasons, we do not keep items of underwear, hairbrushes and combs etc.
- All schools must adequately supervise their pupils at all times and we will not be held responsible for any pupils or their actions or behaviour.
Pool
- Glass bottles or glass material is not permitted into the facilities of Lahinch Leisure Centre for Health and Safety reasons.
- Shaving or the use of razors is not permitted in any area of the facility at Lahinch Leisure Centre.
- Under no circumstances are members or non-members permitted to tamper with or adjust equipment used for the operations of the leisure centre. This includes any individuals tampering with equipment within the , jacuzzi, sauna and steam rooms area. Any individual tampering with Lahinch leisure Centre equipment may result in their Membership being terminated.
- Please remove all items from changing cubicles and place them in the lockers provided.
- Please use lockers provided. Lahinch Leisure Centre takes no responsibility for loss, damage or theft to personal property. Although we will always endeavour to return any articles of lost property to the owner, we do not take responsibility for any item. Such items, if found, will be kept until claimed, but for no longer than two weeks.
- Members/ Non-members must always wear appropriate swim wear, ensuring that bathing suits and shorts are always worn in the swimming pools and heath suite areas. This is mandatory under Health and Safety and Hygiene best practices. Failure to do so will result in you being asked to leave the area immediately.
- No photography or videos can be permitted within any area of the facility at Lahinch leisure centre. This is to ensure the safeguarding and protection of all members and individuals who use Lahinch leisure centre facilities under legislation. Written permission must be sought from Lahinch Leisure Centre under correct guidelines before any use of photography and Video is permitted.
Gym
- Members/ Non-members must always wear appropriate clothing for exercising, ensuring that footwear is always worn in the gym/ exercise areas. This is mandatory under Health and Safety and Hygiene best practices. Failure to do so will result in you being asked to leave the gym area immediately.
- No photography or videos can be permitted within any area of the gym or facility at Lahinch leisure centre. This is to ensure the safeguarding and protection of all members and individuals who use Lahinch leisure centre facilities under legislation. Written permission must be sought from Lahinch Leisure Centre under correct guidelines before any use of photography and Video is permitted.
- The use of lifting chalk is not permitted – liquid chalk only.
- Please use the cleaning stations provided and wipe down machines & benches after use.
- Please use lockers provided. Lahinch Leisure Centre takes no responsibility for loss, damage or theft to personal property. Although we will always endeavour to return any articles of lost property to the owner, we do not take responsibility for any item. Such items, if found, will be kept until claimed, but for no longer than two weeks.
- Members must ensure they put weights back in their original place when finished, failure to do so may result in your Membership being terminated.
- Members must use their unique Fitsense QR code on each visit to gain access to Lahinch Leisure Centre and must not share/ or allow access to the facilities with anyone else. Misuse of your access ID will result in the termination of Membership. Members and non-members access and usage is monitored by CCTV to ensure the safety and security of all individuals.
- Only Lahinch Leisure Centre Personal Trainers are permitted to Train individuals in the Lahinch leisure centres facilities. No other Personal trainers may personal train any member/ non-member on the premises.
- Only Physical/Physiotherapists/Rehab Specialists/ Teachers/Tutors who hold a valid agreement with Management of Lahinch leisure Centre may operate out of Lahinch leisure centre. No other Therapists/ Tutors may train or carry out any rehab/gym sessions with a member/ non-member. Anyone else undertaking members’ training will be asked to leave the gym immediately.
- Equipment and facilities must be used in a safe manner and in accordance with training or guidance given by a qualified member of staff or relevant signage; no equipment or facilities should be used if guidance or training has not been received.
- Use of the Gym involves physical exercise, sport, and recreational activities which can be dangerous and may cause injury. Members’ use of the Gym is voluntary. Members voluntarily assume all risks of injury, damage, or loss which may be sustained because of, connected with, or in any way associated with their use of the Gym.
Class Bookings
- Members must arrive promptly for Class start times. Late arrival may result in being refused entry to the Class.
- We recommend Members book in advance to ensure that a Class has space for them. Members can pre-book Classes when they are posted on out FITSENSE app prior to the start time of the Class.
- If a pre-booked Member is unable to attend their Class, we request, as a courtesy to their fellow Members, they log in to their FITSENSE and cancel the Class in advance so that the space can be made available to other Members.
- By accessing the leisure Centre and using the facilities members are deemed to have read and understood the terms and conditions, rules and regulations of entry to the facility and the correct use of their of membership.
Facility Hire (General)
- The hirer shall be responsible for payment and any other charges to do with the hire.
- The hirer shall not assign or sub-let the right to use the facilities and must only use the facility for the agreed purpose.
- A non-refundable deposit of 2 weeks hire is required to secure an event booking. The remaining balance must be paid in full before your event. Failure to do so may result in cancellation at the manager’s discretion.
- For activities, functions and parties, partial payment of 25% of the overall cost will be made at the time of booking unless permission is granted by the Centre General Manager. The remaining balance must be paid in full before your event Each birthday party will have a set number of children included in the party fee. Any additional children will be charged at a further fee.
- It is the responsibility of the hirer to set up their own equipment. When the booking has ended it is also the responsibility of the hirer to put away their equipment and ensure the hall is left clean
- We seek to maintain high standards throughout the facilities and expect all users and hirers to contribute to this. All hirers will be held responsible for any damage caused by event/activity attendees and participants. The hirer must ensure that all attendees and participants abide by the ‘core terms and conditions’ and the ‘conditions of use’.
- The hirer must ensure that all event/activity attendees and participants show consideration towards local residents living near the Centre – particularly during the evening – as well as members. Noise levels will be kept at a level which is acceptable and will reduce noise levels immediately if instructed by a member of staff.
- All areas shall be left clean, tidy and free from damage. Any additional cleaning, waste removal, repair or necessary replacement undertaken by us as a result of the event/hire/activity shall be charged to the hirer and payable within 30 days.
- Appropriate clothing must be worn for all activities.
- The hirer shall be liable for any additional expenses incurred by us if the event/activity overruns.
- The hirer shall not grant sound, television broadcasting or filming rights without prior conditional
consent from the events manager.
- Any accident, injury or damage must be reported to the Duty Manager/Supervisor immediately.
- You must only park in the designated parking places and only cars displaying disabled badges may
park in the disabled parking bays.
- Any photography or video recording MUST be reported to reception whereby you will be asked to fill out a form and a permit will be issued by the Duty Manager/Supervisor on site.
- The Centre and third parties may carry out general filming and sound recording. Admission to the
Centre signifies your consent to them being used in perpetuity and in all media without any rights to
payment.
- You acknowledge that restrictions and additional terms may apply to events, including but not limited to decoration and pyrotechnics. You must check with the events manager for details of any additional terms or restrictions before making a booking.
- The hirer can only offer an activity similar or the same as that provided by us with written permission of the contract manager.
- Set up and down of equipment will be undertaken during your hire time.
- No equipment can be stored onsite without the written consent of the General Manager.
- If the management at the Centre are of the opinion that the hirer is not making suitable use of the facilities, the management reserves the right to re-allocation any unused parts. We will provide lifeguards for all pool bookings and this will be charged for accordingly. In the case of sub aqua and canoe bookings, suitable cleaning/sanitizing procedures will need to be evidenced at the time of booking.
- All users/hirers must comply with these conditions of use, have regard for the safety of, and behave considerately towards other users, colleagues, the building and equipment. Any user/hirer not doing so may be asked to leave the Centre and must immediately leave if asked. You are responsible for the behaviour of any children you bring to the Centre and must explain any relevant rules and conditions
One off Hires and Club Block Booking
- Your application is only confirmed when you receive written confirmation from the Centre.
- Acceptance of your booking does not guarantee further bookings.
- You must supply, prior to your first session, a copy of:
- Details of all coaches, including first aid, coaching qualifications;
- Affiliation details the club has with the governing body;
iii. Insurance for public liability covering €6,500,000; Professional Indemnity/Products
Liability€2,500,000 & Employer Liability where applicable.
- The hirer should ensure that suitably qualified persons appropriate to the activity shall be in
attendance at all times. Copies of the qualifications should be passed to the management at
the point of booking;
- We, Lahinch Leisure Centre, are not authorised to accept responsibility for the safekeeping of any money or goods. The hirer must communicate this to all attendees.
Event Hire
- You are responsible for ensuring that reception has all the relevant information on time for your booking. Any information not given to reception in advance of your booking may result in cancellation at the manager’s discretion.
- If we are providing catering at your event, we require numbers at least 1 week in advance. Catering is not guaranteed if this information is not provided on time.
Safeguarding
- Clubs or organisations hiring facilities to provide activities which are regulated through the provision of teaching, training, instruction, care for, or supervision of children or adults at risk must provide the Centre Manager details of:
- Club or organisation safeguarding policy;
- Name of the club or organisation safeguarding officer; and Liability
We accept no liability for lost or stolen goods whilst on our premises unless as a direct result of our negligence. Property stored in lockers is at your own risk. Cars parked in the car park and all contents in them are your responsibility and we will not accept liability for loss or damage.
Law and Jurisdiction
These Conditions of Use shall be governed by and construed in accordance with the laws of Republic of Ireland. Disputes arising here from shall be exclusively subject to the jurisdiction of the courts of the Republic of Ireland. Any cause of action you may have with respect to your use of this site must be commenced within 1 year after the claim or cause of action arises.
Declaration
I have read and understood the above Conditions of Use and I agree to be bound by them and any other subsequent revisions. I further understand that these Conditions of Use form only part of my membership and other terms and conditions will apply.
